The owners of “Rosita” only have a 1983 permit for a picnic area and must demolish the later works.
Javea City Council has ordered the owners of the Rosita restaurant in Cala de la Granadella to close it for “lacking a mandatory activity and operating license. This situation is similar to what happened with the closure of restaurants at the southern end of the Arenal beach, which were also open without permission. A sentence on June 1st, 2020 by the Superior Court of Justice (TSJ) of the Valencian Community forces them to close this business also.
Former Town Planning Councilman Vicente Ortolá litigated against this restaurant and against the city council, and won.
El Rosita has only a picnic license granted by the town hall in 1983. Since then, according to the ruling of the TSJ and the municipal decree that now orders its closure, the business has been transformed into a restaurant and its owners have carried out expansion works that now they will have to demolish.
In fact, the city council also orders them to revert to the size that the picnic area had 39 years ago. This modest hotel business consisted, according to the license plans, of a ground floor distributed in a 40 square meter picnic area and a 53.95 m2 terrace.
The owners of the Rosita have ten days to close it down. If they don’t, the local police will visit and seal it off.
